Bimalink Terms & Conditions

1. Agreement to These Terms
These Terms & Conditions govern your access to and use of Bimalink, including our website, platform, mobile experiences, widgets, APIs, integrations, automations, support channels, and related services. By creating an account, accessing Bimalink, or using the service on behalf of an organisation, you agree to these Terms and confirm that you have authority to bind that organisation.
2. The Bimalink Service
Bimalink provides business tools for insurance agencies, teams, and professionals, including client and lead management, contacts, documents, quotes, invoices, payments, bookings, inboxes, messaging, social channels, links, widgets, workflow automation, notifications, analytics, and integrations. Features may vary by plan, configuration, location, integration availability, and the permissions assigned to your account.
3. Accounts and Security
You are responsible for maintaining accurate account information and protecting your login credentials. You must:
- use Bimalink only for lawful business purposes;
- keep passwords, OTPs, API credentials, tokens, and connected account access confidential;
- ensure users in your organisation have appropriate roles and permissions;
- notify us promptly of unauthorised access, suspected compromise, or security incidents;
- ensure all information you submit is accurate, lawful, and not misleading.
4. Customer Data
You retain ownership of data, files, records, and content that you or your users submit to Bimalink. You grant Bimalink the rights needed to host, process, transmit, back up, display, and use that data to provide, secure, support, and improve the service. You are responsible for obtaining all consents, notices, permissions, and legal bases required to upload or process customer, lead, policyholder, contact, or third-party information in Bimalink.
5. Acceptable Use
You must not use Bimalink to:
- violate any law, regulation, contractual duty, privacy right, intellectual property right, or industry rule;
- send spam, phishing, fraudulent, deceptive, harassing, harmful, or unlawful communications;
- upload malware, exploit vulnerabilities, bypass security controls, scrape the service, or interfere with platform availability;
- access, modify, or disclose data you are not authorised to use;
- misrepresent insurance products, pricing, policy terms, claims, approvals, licences, or regulatory status;
- use automations, AI features, or messaging tools in a way that causes unlawful discrimination, unfair treatment, or misleading outcomes;
- reverse engineer, copy, resell, sublicense, or commercially exploit Bimalink except as expressly permitted by us.
6. Insurance, Financial, and Professional Responsibility
Bimalink is a software platform. We do not act as an insurer, broker, agent, underwriter, financial adviser, legal adviser, or tax adviser unless expressly stated in a separate written agreement. You are responsible for verifying all policy, premium, commission, quote, invoice, payment, claims, renewal, regulatory, and customer communication information before relying on it or sharing it with third parties.
7. Integrations and Third-Party Services
Bimalink may connect with third-party services such as email, calendar, storage, WhatsApp, social media, payment, AI, messaging, and notification providers. Your use of those services is also governed by their terms and policies. We are not responsible for third-party service availability, security, data handling, pricing, or changes. You may need to maintain active third-party accounts, credentials, permissions, and approvals for integrations to work.
8. AI, Automation, and Communications
Bimalink may include automation, suggested replies, workflow triggers, and AI-assisted features. These tools are designed to support your work, not replace human review. You are responsible for configuring workflows carefully, reviewing outputs, testing automations, monitoring communications, and ensuring messages are accurate, lawful, authorised, and appropriate for recipients.
9. Subscriptions, Fees, and Payment
Some Bimalink features require a paid subscription, add-on, usage allowance, or marketplace installation. You agree to pay applicable fees, taxes, renewal charges, and usage-based charges for the plans and services you select. Fees are generally non-refundable unless required by law or expressly stated by Bimalink. We may suspend or limit access if payment is overdue, a payment fails, or use exceeds plan limits.
10. Intellectual Property
Bimalink, including its software, design, workflows, trademarks, logos, documentation, and platform content, is owned by Bimalink or its licensors and is protected by intellectual property laws. These Terms do not transfer ownership of Bimalink to you. You may use the service only as permitted by these Terms and your subscription.
11. Confidentiality
Each party may receive non-public information from the other. The receiving party must protect confidential information using reasonable care and may use it only to perform under these Terms, except where disclosure is required by law or authorised in writing.
12. Service Changes and Availability
We may update, modify, suspend, or discontinue parts of Bimalink from time to time. We aim to provide a reliable service, but availability may be affected by maintenance, upgrades, outages, third-party providers, security events, network issues, or factors outside our control. We are not liable for temporary unavailability or loss caused by events beyond our reasonable control.
13. Suspension and Termination
You may stop using Bimalink at any time. We may suspend or terminate access if you breach these Terms, fail to pay fees, create security or legal risk, misuse the service, or if required by law. After termination, your access to the service may end and data may be deleted or retained according to our Privacy Policy, legal requirements, backup cycles, and any applicable subscription terms.
14. Disclaimers
Bimalink is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not guarantee that the service will be uninterrupted, error-free, secure against every threat, or suitable for every business purpose. We do not guarantee outcomes from automations, integrations, AI outputs, communications, quotes, invoices, policy workflows, or business decisions made using Bimalink.
15. Limitation of Liability
To the fullest extent permitted by law, Bimalink will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, reputational harm, or third-party claims arising from or related to your use of Bimalink. Our total liability for any claim relating to the service will be limited to the amount you paid to Bimalink for the service giving rise to the claim during the three months before the event occurred, unless applicable law requires otherwise.
16. Indemnity
You agree to defend, indemnify, and hold Bimalink harmless from claims, losses, damages, liabilities, costs, and expenses arising from your data, your use of the service, your breach of these Terms, your violation of law, or your infringement of third-party rights.
17. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify users. Continued use of Bimalink after updated Terms become effective means you accept the updated Terms.
